How Much is My Claim Worth?

Naturally, when making a claim for compensation, people wish to know how much they will be looking to receive as soon as possible. The amount of money a person will receive for the injuries they have sustained is a matter of individual assessment.

We can refer to previous cases as a guide to ascertain roughly how much you may receive in compensation as a result of your claim with Mercury Legal.

There are also additional costs that can be recovered and we can factor these into the settlement along with pocket expenses, loss of earnings and rehabilitation costs.

Will I Have to Go to Court?

Very few personal injury compensation claims go to court.

The process is extremely expensive and this deters the person responsible for the injury and their insurers as they will be liable for all court costs.

If there is no dispute regarding who was at fault for the accident and the full extent of the injuries sustained, the insurance company will often settle the claim prior to court proceedings being commenced. Again, they would rather do this than pay the court fees.

In cases where there is dispute on one or a number of issues, you may be required to attend court. Mercury Legal will do everything in our power to ensure this is not the case. All of our personal injury solicitors have extensive litigation experience and we will guide you through the whole of the Court process.

Whilst we will issue Court proceedings in cases where it is necessary, very few cases ever reach a final trial. In fact, of all the cases we deal with, just a handful reach this stage.

Occasionally, if your opponents simply will not agree a reasonable figure for your compensation, it may be better for a claim to proceed to a trial as this way a Judge can decide how much compensation should be payable.

How Long Will a Claim Take?

This is a question that unfortunately cannot be answered straight away. Mercury Legal will not indicate any offer as accepted until we have had clear and conclusive information from medical experts confirming your symptoms.

Every personal injury case is unique and as such, no definitive timetable can be given. Every individual deals with injury differently and therefore heal at different speeds.

Here at Mercury Legal, we pride ourselves on the level of care and support we provide to our clients. In some instances we may be able to give some rough indications depending upon the case scenario. For example, simple injuries with no issue of liability may take between six and eight months and road traffic insurers look to pay out as quickly as possible. We never rush a case as this could compromise the payout you receive.

Once settlement is reached, this is final. So if you suffer a relapse or deterioration following your injuries and you have already closed the case; there is no going back. Mercury Legal will be looking to get the best out of your claim and will be on hand to guide you through what can be an arduous process.

What Does a Claim Cost?

We are often asked how much a claim will cost an individual. The answer is very simple; we will pursue your claim at no upfront cost to you and you will not have to pay anything if your claim is unsuccessful through no fault of your own.

Where possible, all of our legal fees will be recovered from the person responsible for your injury or their insurance company.

From 1st April 2013, if your claim is successful, your award will be increased by 10% and we may charge up to 25% of your damages to cover our fees depending upon your case.

How Much Will I Receive?

When making a personal injury claim, clients are perfectly within their rights to ask how much they may receive in compensation. It is, after all, the fundamental reason for filing a case.

As experienced personal injury Lawyers we consider similar previous cases as a guide to give you an idea of how much compensation you may be able to expect. Exactly how much you will get is an impossible calculation as each case is judged individually on its merits and there are many factors involved.

As well as the personal injury you have suffered, there are things like loss of earnings, rehabilitation costs and general expenses that have to be factored into the equation. We will always do our best to give you as accurate an estimate as possible.

How Do We Fund Your Case?

No win no fee is exactly what the name suggests, you pay nothing up front and If you are unsuccessful in your personal injury claim through no fault of your own then it will not cost you a penny. You may also hear no win no fee claims being referred to as Conditional Fee Arrangements (CFA’s).

From 1st April 2013 under new legislation if your claim for compensation is successful your award of damages will be increased by 10%. At the end of your case, once you have won and received the money you deserve, we may charge up to 25% of your damages to cover our fees, however this depends on your individual case.
