Bullying /Harassment/Assault in the Workplace Claims
Claims for Bullying and Harassment in the workplace like all other stress related claims can be pursued against an employer in the County Court.
Special provision is made for claims for harassment under the Protection from Harassment Act 1997. This Act prohibits harassment – A person must not pursue a course of conduct which amounts to the harassment of another. The purpose of the Act is to protect victims of harassment whatever form the harassment takes and whenever it occurs. The Act stipulates that there must be a course of conduct which the person knows, or ought to know amounts to the harassment of another – would a reasonable person think that it was? The Act does not set out a clear definition of ‘harassment’ but, it includes causing anxiety or distress.
The Act also creates a criminal offence of harassment. However, criminal proceedings can only deal with ‘offences’ which have been committed.
