There has been significant press coverage recently surrounding the issue of former coal miners receiving compensation for knee problems developed as a result of their working practices. Some of the published reports are a little misleading as the suggestion seems to be that lump sum compensation awards are now available via the Court system. In fact, the recent developments relate to the introduction of a new industrial disease to the prescribed list for which a tax free pension can be claimed from the Department of Work and Pensions under the industrial injuries disablement benefit scheme.

The new prescribed disease, to be known as Miners Knee (prescribed disease PD A14) is now available and enquiries should be made direct to your local benefits office for further information.
Although the pension itself is tax free it can affect other pensions or allowances that you may be receiving and as such we would recommend that you seek advice from your nearest Citizen’s Advice Bureau or a similar welfare rights organisation before lodging a claim to ensure that you are not financially worse off as a result of claiming.
With regards to lump sum compensation payments, a number of test cases are still awaiting resolution; and until they are decided it remains difficult to lodge a civil claim.
