Beat Knee
You may have heard a lot of recent press about Beat Knee claims and knee injuries in general. Most of the press reports centre around the mining industry where many thousands of men now complain of knee injuries and while of course many former mineworkers are suffering from this condition it is not just limited to this industry. If you have ever worked in conditions where you have spent plenty of time on your knees in direct contact with a hard surface and suffer from pain in your knees then you may have a claim.
Beat knee is caused by pressure on the knees from prolonged periods of kneeling or bending and can also be caused by other common work day practices such as climbing ladders. The main symptoms are pain around the knee cap and occasional swelling around the joint.
Successful beat knee cases are currently a rarity but we are hopeful that current test litigation progressing through the Court system will pave the way for many workers who currently suffer with debilitating knee symptoms to be compensated. The test litigation is not limited to beat knee as a specific compliant but is also looking to see if employers who caused their employees to develop arthritis in the knee joints can be held accountable for the injuries.
In relation to coal miners, there remains the chance that the Government will look to set up a scheme along the lines of the previous vibration white finger, deafness and chronic bronchitis and emphysema schemes which have operated in the past. Until such time as the test cases are resolved in the Courts and/or the Government announce a formal scheme the legal costs of pursuing claims for beat knee and arthritis of the knees remains prohibitive and few if any private practices are actively running cases under no win no fee arrangements.
