Very few personal injury compensation claims go to court.
The process is extremely expensive and this deters the person responsible for the injury and their insurers as they will be liable for all court costs.
If there is no dispute regarding who was at fault for the accident and the full extent of the injuries sustained, the insurance company will often settle the claim prior to court proceedings being commenced. Again, they would rather do this than pay the court fees.
