Do I have to let my insurance company run my car crash claim for me?

This is a question we are asked time and again, and the short and unequivocal answer is NO.

 

Insurance companies will try and bully and baffle you by telling you that you have to allow them to deal with everything about your claim, from the repair to your personal injury compensation, and the fact is simple, you have the choice of who deals with every aspect of your claim.

 

You choose the garage that does your repair, you choose the solicitor that deals with your claim, you insist on a like for like replacement vehicle when your car is off the road.

 

Indeed it is sometimes foolish to allow your insurance company to deal with your personal injury claim, as there is a possibility that they will also be insuring the person responsible for your accident.

 

This means they are actually paying out for your claim themselves, so you can see why this could cause a conflict of interest and may not always be the best deal for you.

 

You may also get the insurance company of the person who caused your accident ringing you directly, and asking you to quickly settle your claim without resorting to solicitors.

 

But think about it!  They may want to settle your claim quickly, but they also want to settle it as cheaply as possible.

 

If your injury turns out to be longer lasting than you first thought (because the chances are you will have settled your claim without being examined by a specialist doctor), then you cannot go back to the insurance company for more money at a later date. That’s it, no turning back .  You have accepted their offer, no matter how serious or long lasting your injury may turn out to be.

 

Bear in mind you will also have accepted the offer without the luxury of any legal advice.  Most people do not know how significant their injuries are, so therefore how would they know if an offer is a reasonable one.
